The case was postponed to allow the state to furnish the defence with contents of the docket.

TAVERN shooting case postponed.

The case was rescheduled to 3 June to allow the state to furnish the defence with contents of the docket.

Bongani Nkosi (39) and Mduduzi Lubisi (43) appeared in the KaBokweni Magistrates Court on Thursday, 22 May.

Nkosi was supposed to apply for bail on new facts, while Lubisi was to make his first bail application after abandoning bail in January 2025.

Defence lawyer Khaliphi Ncanca told the court seeing that the investigation is complete, he wants to make an application for further particulars.

"I request transcripts to be prepared for bail proceedings already conducted for accused number two. I request for disclosure of the docket for preparation of the bail application. Seeing that the investigation is complete, it will assist me tremendously if I should proceed with bail," he said.

State prosecutor Belinda Williamson objected to the application and told the court that giving the defence contents of the docket will jeopardise the case.

She said the defence has to use regular procedure to apply for bail.

Magistrate Musa Mabunda postponed the matter to 3 June for further particulars and records for transcripts in respect of accused number one.

Nkosi and Lubisi face nine counts of murder, one count of attempted murder and defeating the ends of justice.

They were arrested in January 2025 following a mass shooting that claimed the lives of nine people at a tavern in Pienaar.

The accused allegedly shot the deceased execution-style outside the tavern. Six of the victims died at the scene while three others succumbed to their injuries in hospital.
