MKP10 is appealing the Western Cape High Court judgment to dismiss their application to be reinstated as MKP MPs.

According to the party's national organiser Floyd Shivambu, the appointment of new members is expected in a few weeks' time.

PLANS are afoot to replace 10 expelled MK party members of Parliament.

This follows the Western Cape High Court decision to dismiss their Monday, 9 September, urgent application for reinstatement.

According to the party's national organiser Floyd Shivambu, the appointment of new members is expected in a few weeks' time.

"The Western Cape High Court didn't agree with former MK party members of Parliament that they were unfairly recalled. We'll, over the next few weeks, be deploying skilled, capable and organic Warriors as public representatives. We're assembling the best of the best," Shivambu said.

The court found that the MK party 10 failed to establish a reasonable apprehension of irreparable harm and the existence of no alternative remedy available to them.

They're among 18 members who were allegedly informed by the party's leadership not to proceed to be sworn in as MPs, but they went ahead.

However, the swearing-in of new members may be spoiled by the group's intention to appeal the judgment.

They said they tried to avoid the matter coming to court by settling out of court, but MK party lawyer Advocate Dali Mpofu SC and party MP Duduzile Zuma stood on the way of the finalisation of the settlement.

When the matter was heard on 3 September, the court had to abruptly halt proceedings when the lawyer representing the aggrieved members, Advocate Simba Chitando informed the judge that he had received new instructions that parties may have reached a settlement.

But it wasn't to be.

Group spokesman Thami Khuzwayo told EWN that their lives have been threatened since their removal.

He confirmed that they were proceeding with the appeal and the group will also continue with Part B of the matter, which is to review the process followed by the MK party when dismissing them.

Khuzwayo said: "Some delaying tactics have had a significant effect on the way our advocate represented us. Also, we feel the process was unfair because of that."
