THE murder case involving the alleged killer of ANC Ward Councillor, Molefi Sello in the City of Matlosana suffers yet another postponement in the Klerksdorp Magistrates Court.

The accused, Thapelo Apache Thejane appeared in court on Tuesday, 5 May before Magistrate Lindiwe Tsengiwe.

The matter was postponed to Friday, 15 May, where a new magistrate is expected to take over and preside over Thejane's bail application.

This after Tsengiwe recused herself from the matter on Tuesday following allegations made by defence lawyer Kenny Kgomongwe, who accused her of violating his client's rights.

Kgomongwe claimed that the magistrate allowed media recordings in court without the knowledge or consent of the defence.

He further alleged that journalists were seen entering the magistrate's chambers without both defense and state lawyers present, raising concerns about fairness and possible bias.

He argued that these actions could undermine the accused's constitutional right to a fair trial and formally requested that the magistrate step aside.

Although Tsengiwe dismissed the allegations, maintaining that media access was properly authorised and that no discussions about the case took place in her chambers, she agreed to recuse herself "in the interest of justice".

The unexpected development has delayed the bail proceedings.

Since his arrest, Thejane has now appeared at least four times at the Klerksdorp Magistrates Court in the North West. He remains in custody until his next court appearance.

Thejane was arrested on the same day of the incident, Friday, 13 February after handing himself over to Klerksdorp police.

He allegedly stabbed the councillor to death outside a popular tavern following an argument.
