The matter returned to the Randburg Magistrates Court in Joburg on Friday, 30 October, where it was postponed to 6 November 2026 for its transfer to the regional court.

During proceedings, the state sought a postponement, but defence lawyer M Kapela objected, arguing that Lincks was being prejudiced by repeated delays.

Kapela told the court that the matter had already gone through pre-trial proceedings and had been certified trial ready.

“The prosecutor applied himself to the docket, decided on the charges to prefer against the accused and sent a letter to court.

“When that letter came to this court, pre-trial proceedings proceeded,” he argued.

He said the state had already had an opportunity to prepare the case and shouldn’t be allowed to delay proceedings at the last minute.

“My client enjoys a right to have his trial speedily heard. That right was given to him by the Constitution,” Kapela told the court.

He also questioned why the state was introducing additional charges, including charges falling under the Domestic Violence Act, which hadn’t been brought to the defence’s attention during earlier proceedings.

In his ruling, Magistrate Magolego expressed dissatisfaction with how the state had handled the matter.

“The court is also not satisfied with how the state conducted itself in these proceedings. I want to express my concern,” he said.

Magolego said the court hadn’t been informed during the pre-trial conference that Lincks was facing charges falling under the Domestic Violence Act.

“I would not have proceeded with the pre-trial ruling,” he said.

The magistrate pointed out that the matter had previously appeared in court twice, with both the accused and state witnesses having been warned to attend.

However, he explained that the court couldn’t interfere with the National Prosecuting Authority’s decisions on charges and the prosecution of cases.

“The court has no authority to control and make directions over these issues,” he said.

The matter was postponed to 6 November 2026 for transfer to the regional court.

Speaking to Daily Sun outside court, Nare said she was happy about the move to regional court.

“This for me is a win, even though it doesn’t mean we’ve won the whole case. This is the one postponement I’m happy about. I’m happy to go to regional court,” she said.
