The duo briefly appeared in the Pretoria Magistrates Court on Friday, 30 October, where they stood far apart from each other in the dock.

The state didn’t oppose their bail applications.

The duo faces charges of defeating the ends of justice, assault and contravention of the National Prosecuting Authority Act.

The matter was postponed to 2 February 2027 for further investigations.

The case relates to an alleged assault on Brigadier Leonora Phetlhe by Khan on 26 June 2018.

Phetlhe, who was serving under Khan at the time, reportedly sustained injuries and opened an assault case at Silverton Police Station.

However, the investigation allegedly uncovered interference with the case by Johnson, who was a National Prosecuting Authority employee at the time.

Testimony at the Madlanga Commission revealed allegations that Johnson accessed and shared confidential police docket information with Khan.

The information allegedly included Phetlhe’s statement and a medical report, giving Khan access to details of the complaint before he was formally interviewed by investigators.

Johnson resigned as head of the Investigating Directorate Against Corruption in July 2026 following her appearance before the commission.

Khan was dismissed from the police service in September 2026 after failing to attend an internal disciplinary process.

Meanwhile, Parliament’s Portfolio Committee on Justice and Constitutional Development chairman, Xola Nqola said nobody was above the law.

“The committee has consistently maintained that no individual, regardless of their position or former office within the security and justice cluster, is above the law,” he said.
